MYPORTOHELI VILLAS - TERMS AND CONDITIONS
1. Content
1.1. MYPORTOHELI villas offer a selection of villas ranging in size and style, catering to different tastes, varying from small quiet cottages with pool, vineyard retreats, beachfront villas with private beach and dock, to seaside villas with helipad. Appropriate for all seasons, due to the moderate climate and high temperatures that the area enjoys 8 months a year, the villas are beautiful and majestic all year round.
1.2. By completing a reservation, the Client acknowledges and agrees to have read, understood and agreed to the Terms and Conditions set out below, and accepts that these establish a legally binding agreement with the Property Owner of the villas.
1.3 The Terms and Conditions set out below are applicable even in cases where the Client has booked through an Agent/Agency and not directly with MYPORTOHELI villas.
2. Rent/price and Payment Schedule
2.1. Any and all transactions, including deposits or payments, which take place in reference to MYPORTOHELI villas shall be deemed for all intents and purposes to have taken place in or at Greece.
2.2. MYPORTOHELI villas will provide booking details to the Client. Upon acceptance, the Client shall pay an initial deposit by the agreed date (an agreed percentage of the booking cost depending on the booking and as shall be stipulated), to secure the booking. Once the funds have been received, the booking shall be deemed confirmed. The Client must pay the balance of the amount due for the Booking, no later than 60 days prior to the start of the tenancy. Should the Client fail to do so, the sums paid are non- refundable and the booking shall be cancelled. If a booking is made within 60 days of the start of the tenancy, the full amount must be paid at once.
2.3. Should there be any changes in law, between the time of receipt of a booking confirmation from MYPORTOHELI luxury villas and the end of the tenancy, leading to an increase in taxes, fees and/or charges applicable to the rental agreement (including the utilities charges), the Client will have to cover this excess. MYPORTOHELI villas will try to notify the Client as soon as reasonably practicable after becoming aware of such changes.
2.4. The total booking amount along with its corresponding security deposit, as per clause 4.2 below, will have to have been received in full prior to entry to the Villa.
2.5. Cyber crime: Due to an increase in cyber crime, remittances are only deemed valid if RECEIVED in landlord account. Please make sure to always verify any new or changed account details over the phone on the office number 0030 210 8981310. If you have any doubts or concerns please bring it to our attention on the above number.
3. Amenities and facilities
3.1. The villas provide comfort and privacy, combined with quality services. The Villa will be cleaned and maintained to a high standard throughout the rental period, with the pool and gardens regularly tended.
3.2. The following shall be provided to the Client during a short term rental and are included in the Rent/Price:
- All utilities, (i.e. electricity, water, internet connection, WIFI, satellite TV, heating oil, except telephone which is completely excluded), provided used with care as per the typical reasonable consumption levels for each villa. If of interest, please refer to the specific villa allowances in each instance, which have been set on the basis of previous full occupancy averages. In case of excessive use above threshold levels, the Client may be required to cover the excess use, as MYPORTOHELI villas may in their reasonable discretion specify.
- Daily cleaning of the property
- Linen (bed sheets, bathroom towels, pool towels) changed twice a week
- Any additional benefits and/or services that are specifically offered by or agreed with the Property Owner. In the event of a long term rental (typically in excess of 4 weeks), the Client shall be liable for all utilities and related costs.
3.3. A detailed inventory of the property and its contents will be given to the Client on his arrival at the property, for his perusal. This will form the benchmark for checking any damages at Check out. A list of ‘House Rules’ may also be given to him that should be respected by him and his guests and all members of his party.
3.4. The Client shall keep the property in excellent condition (excepting reasonable wear and tear) and shall not make any alterations thereon without MYPORTOHELI villa’s prior written consent. In the event that the Client wishes to install items at the Villa (temporarily or otherwise), prior written approval should be obtained, and the Client may be liable for the cost and time to reinstate at the end of the Tenancy, as MYPORTOHELI villas shall in their sole discretion determine.
3.5. At times, there may be power cuts in the area, on the part of the public service operators; MYPORTOHELI villas will do their best to restore operation, but they cannot be held responsible for any damage and/or inconvenience that may have been caused.
3.6. The Client agrees to occupy and use the Villa in such manner as to not disturb the peace or breach applicable legislation. Consideration should also be given to neighbours and other people.
3.7. The Client shall respect the number of people agreed that may use the property for the specific booking. If the Client has more guests and staff than initially agreed, then MYPORTOHELI villas, and/or the Owner must be informed and give their prior consent. In such case an extra charge may apply as MYPORTOHELI villas and/or the Owner will in their sole discretion determine, calculated on the basis of half the pro rata amount pertaining to each extra occupant.
3.8. Events and parties are not allowed in the Villas unless previously agreed to, in writing. In such case, an extra amount may be due, as may be agreed between the parties.
3.9. Pets are not allowed in the Villas unless otherwise previously agreed in writing.
3.10. Smoking is not allowed in bedrooms. Residents and guests are required to use ashtrays and in no instance throw cigarettes in the gardens, as this could lead to fire.
3.11. Toilet paper (or any other items or food) must not be thrown in the toilets as it is likely to get the sewage tank congested.
3.12. Photographs taken of the property may not be published through any medium, nor used or sold for profit.
3.13. In case of a damage, defect or problem in the Property or its Content, the Client must immediately inform MYPORTOHELI villas so that any remedial action necessary may be taken. Where there is Client/tenant fault or negligence involved, the Client will cover all costs, whilst where it is a matter of manufacturing/ construction defect and /or fair wear and tear, the Owner will cover the cost. In case of a major defect, rendering the house uninhabitable, MYPORTOHELI villas may either provide alternative accommodation or offer different dates. No reimbursement or compensation will be due.
3.14. The Client shall allow access at reasonable hours of the day subject to reasonable notice, for the purpose of carrying out repairs and/or maintenance matters and/or inspections.
3.15. The Client should take their own steps to insure and safeguard any valuable items. MYPORTOHELI cannot be held liable for, inter alia:
- any loss, damage and/or destruction to items of the Client, whether or not burglary is involved;
- any accidents or death that may happen to the Client, or his guests or other members of his group in the Property, whether or not, the accident is due to a defect in the Property.
3.16. Check in time is between 16.00 and 21.00pm. Check out time is by 10.30am. The Client agrees to leave the Villa no later than the designated checkout time. Failure to leave by the agreed time, may cause disruption with the next incoming people and so the Client may be required to compensate MYPORTOHELI villas and/or the next Client for any loss/ inconvenience/ damage sustained as a result. In case of any particular requests these can always be discussed and agreed in advance.
4. Damages
4.1. The Client is responsible for leaving the Property in the condition it was in on arrival save fair wear and tear. The Client is responsible for its own acts and omissions as well as those of its guests.
4.2. At the time of the booking, the Client is required to pay a security deposit of up to 25% of the weekly Rent/Price in order to cover for any damages, breakages and/or loss of items caused to the Property. The Security Deposit must be paid no later than 60 days before the start of the tenancy.
4.3. The Client must inform MYPORTOHELI of any damage or loss to the Property or its Fixtures and Fittings, when they happen and shall permit MYPORTOHELI to inspect and if necessary, repair at any reasonable time stipulated with due notice.
The security deposit shall be returned to the Client once any funds due on account of damages/ losses, and /or others sums due by the Client, have been assessed and deducted following the Check out of the Client. MYPORTOHELI villas will endeavour to have assessed any such sums due, within 20 days of the departure of the Client.
4.4. The Client recognizes than the security deposit (mentioned under par. 4.2 above) may not be enough to cover items of high value that may be in the Property (antiques, paintings, carpets, furniture, etc), or if excessive damage is caused to the Property, in which event, the Client will have to cover any shortfall promptly accordingly.
5. Cancellations
5.1. In the event of a cancellation of a rental by the client:
5.1.1. If cancellation occurs earlier than 60 days before the beginning of the rental period agreed with the client, then the advance payment will be retained and no refund/ compensation of any kind is owed to the Client.
5.1.2. If cancellation occurs 60 days or less before the beginning of the rental period agreed, then no refund will take place of the amounts pertaining to the stay (i.e. the full amount will be non- refundable). In this case, only the security deposit will be returned if previously received.
5.1.3. Early departures by the Client will entail no refund.
5.2. If, after having confirmed a rental and received all or part of the rent/price MYPORTOHELI villas (exclusively and not the Client) are for some reason unable to accommodate the rental, MYPORTOHELI villas will either:
5.2.1. Offer the Property to the Client on different dates, subject to acceptance by the Client; or
5.2.2. Offer the Client alternative accommodation subject to availability and the Client’s acceptance; or
5.2.3. Reimburse to the Client any amount of rent received by the Client until then. In such case the refund of the Rent received will be the limit of any liability on the part of MYPORTOHELI villas. Consequently MYPORTOHELI villas and/or the Property Owner can in no instance be held liable for travel expenses, alternative accommodation or other expenses that may be incurred.
MYPORTOHELI villas also reserves the right to in its sole discretion upgrade the Client to a different villa (of similar or higher value), if deemed necessary.
6. Liabilities
6.1. MYPORTOHELI villas, the Property Owner and other services providers will be held harmless and will not be held liable or responsible towards the Client, the occupants or their guests for, amongst other things, indicatively the following events:
- Disaster, acts of God, accident, or unforeseen event that may affect the vacation rental.
- Accidents or injuries occurred or sustained during the Client’s stay.
- Articles lost, stolen, or left behind in the Property during the Client’s stay, and/or for any damages to persons or their property while at the rental Property.
Any other thing not involving a direct act of MYPORTOHELI and/or the Property Owner leading to damage.
6.2. The Client agrees to hold harmless and indemnify MYPORTOHELI villas, the Property Owner and other service providers from any and all costs, expenses, legal proceedings, legal fees, suits, claims or demands, whether from loss or life injury to the Client and/or invitees of the Client.
6.3. The Client recognizes that the supervision, safety and behavior of the Client’s children and guests are the Client’s sole responsibility.
MYPORTOHELI villas and the Property Owner can have no liability for injury, illness, death, loss or damage to the Client or a member of his party or guests, arising out of or in connection with the use of the rental property, the swimming pool, the children’s play areas, any sport facilities or any other use of the property and its related facilities. The use of the facilities are at the sole risk of the Client.
6.4. The Client accepts that if in the opinion of MYPORTOHELI luxury villas, the Property Owner or any other person with landlord authority, the Client or a member of their group, or guest behaves in a manner which causes or is likely to cause a danger, excessive disturbance (e.g. to neighbours), damage to the Property, or acts in breach of any provision of the booking agreement, the rental may be terminated immediately and the Client shall be asked to leave the Property. In this event, the Client shall not receive any refund and he/she shall be fully liable for any costs and expense incurred as a result of their behavior or the behavior of the persons in their group or guest.
6.5. The Client is advised to place any valuables in a safe box as well as to insure his/her personal belongings, or any other valuable items kept in the Property, as well as to insure their staff, and have a third party liability cover.
6.6. Notwithstanding the above, in the event that MYPORTOHELI villas and/or the Property Owner, were to be held liable for anything, in any event, the liability is limited to the amount received for the booking less any costs incurred.
7. Force majeure
If the booking has to be entirely or partially cancelled by either the Property Owner or the Client, due to Force Majeure (defined as per the Greek Law and jurisprudence), where such circumstances make it impossible for the rental period to take place as contracted, the Property Owner may at his sole discretion, offer an alternative date for the rental, offer alternative accommodation or a full or partial refund, excluding costs incurred by the Owner in respect to the Client’s request or any loss suffered (including loss of earning) on account of Client not being able to come and MYPORTOHELI not being able to relet it. There is no obligation though on the owner’s part to do so in cases of Force Majeure. Late arrival at or early departure from the villa due to travel disruptions and/or adverse weather conditions are excluded from this, and no refund will be made.
8. Insurance
8.1. The Client is advised to take out travel insurance that will cover individuals not only for loss of money already paid if the rental is cancelled, but also covers him in case of damage to the property during his stay which he has caused and for which he is responsible.
8.2. The Client is responsible for his third party liability, health and medical repatriations insurances. MYPORTOHELI villas or the Property Owner will not offer such insurances and shall not be held liable for the absence of such insurances.
9. Governing Law
This agreement shall be governed by Greek Law. All disputes arising out of or in connection with this agreement, including torts, will be submitted to Greek Courts in Athens.
10. Covid-19
For good order's sake it is clarified, that in cases where MYPORTOHELI is open and ready to welcome the applicant, but the applicant last minute cancels his rental period due to a COVID travel ban, such that MYPORTOHELI are unable to relet it for the same period and/or at the same rate, the sums paid shall be non refundable but MYPORTOHELI villas would look to welcome the Client at another time within the next 18 months (subject to availability and rate changes). This applies solely to cases of objective inability to travel on behalf of the principal of the booking (due to travel ban), and not should travel somehow be possible (e.g. via connecting flight through another country) nor for other cases (e.g. sickness etc). In all other cases, MYPORTOHELI villas may, depending on circumstances, at its sole discretion decide to offer some credit voucher (there being no such requirement, and in no instance refund) but shall not be required to do so and the normal cancellation policy will apply.
